Access was obtained through misrepresentation of authority to the Firm's third party archiving vendor. These illicitly accessed communications contained the Firm's confidential and proprietary business information, as well as privileged communications between Firm principals and employees and counsel. Certain privileged communications referenced communications with Canadian regulatory and law enforcement authorities regarding [Third Party] and [Company] (Canada). Due to the nature and volume of emails accessed and downloaded, it is the Firm's conclusion that these actions were knowing and intentional. These actions have been reported to the Joint Serious Offenses Team and the Ontario Securities Commission.
