Broker Comment: IN RESPONSE TO AN AUDIT, I WAS ASKED TO RESPOND TO SOME QUESTIONS. IT WAS NOTED THAT I MADE 5 PAYMENTS OF $400 EACH (OCT 2001-APRIL 2002) INTO A CLIENT'S ACCOUNT. THE CLIENT WAS A PAINTER WHO WORKED FOR ME AND HE ASKED THAT I MAKE THE CHECKS PAYABLE TO JACKSON NATIONAL LIFE.IN ANOTHER SITUATION, I RECEIVED A CHECK FROM A CLIENT PAYABLE TO ME AND I WROTE A CHECK (MARCH 15, 1999)PAYABLE TO NATIONWIDE (INSTEAD OF MAKING CLIENT REWRITE THE CHECK).IN BOTH CASES, COPIES OF ALL CHECKS WERE IN THE CLIENT FILES AND THERE WAS NO ALLEGATIONS OF MISAPPROPRIATION OF FUNDS. THERE WAS ONE OTHER CLIENT FOR WHOM I WROTE CHECKS FROM MY PERSONAL ACCOUNT (MARCH 1999 & JAN 2000)THE TOTAL OF WHICH WAS $200, BUT THIS WAS NOT NOTED IN THE AUDIT. I NOW KNOW HOW SERIOUS THIS IS, AND I WON'T COMMINGLE FUNDS OR WRITE CHECKS TO CLIENTS FROM MY ACCOUNT.IN REGARDS TO OUTSIDE BUSINESS ACTIVITIES, I AM A TRUSTEE & CO-TREASURER OF THE BRAINTREE SON'S OF ITALY LODGE, AND MY INVOLVEMENT WAS NOT ADEQUATELY DISCLOSED. ON BEHALF OF THE LODGE, AND ON THE BOARD'S DIRECTION, I HAD AUTHORIZED THE WITHDRAWAL OF INTEREST AND HAD THE CHECK MADE OUT TO THE BRAINTREE SON'S OF ITALY. (JULY 2002) THE CHECK WAS MAILED TO ME BECAUSE THE MAIL AT THE LODGE COULD BE PICKED UP BY ANYONE AT THE LODGE. NO ALLEGATIONS WERE MADE ABOUT MISPROPRIATION OF FUNDS.IN A PHONE CONVERSATION WITH NATIONAL PLANNING'S FRED FRAM, I WAS ADVISED THAT I SHOULD BE SUBJECT TO CLOSER SUPERVISION, BUT WITH MY OSJ BEING IN THE MIDWEST, THAT WOULD PROVE DIFFICULT. I WAS ADVISED THAT I SHOULD LOOK FOR A NEW BROKER DEALER THAT MIGHT BE BETTER ABLE TO WORK WITH ME.
