Broker Comment: REP INDICATES THE CLIENT LIKED THE TECHNOLOGY STOCKS AND WOULD OFTEN CONTACT HIN TO OBTAIN THE FIRMS OPINION ON THESE STOCKS. REP DENIES HAVING PRESSURED THE CLIENT INTO ANY DECISIONS MADE IN REGARDS TO THE TRADES IN THE CLIENTS ACCOUNT. REP STATES SOME STOCKS WERE SOLD TO LOCK IN GAINS AND IF THE STOCK LATER BECAME ATTRACTIVELY PRICED HE WOULD RECOMMEND PURCHASING THE SHARES AGAIN. THE CLIENTS PORTFOLIO DID CONTAIN SOME NON-TECHNOLOGY STOCKS SUCH AS GILLETTE, LOWES AND DOLLAR GENERAL. IT APPEARS ALL TRANSACTIONS WERE BASED ON CONVERSATIONS WITH THE CLIENT AND WERE PLACED WITH THE CLIENTS AUTHORIZATION.

HE CLAIMS IR DID NOT ADVISE HIM OF THE $1,000,000.00BREAKPOINT AND INDICATES HE COULD HAVE SAVED OVER $30,000.00 INCOMMISSIONS. REQUESTS THE CANCELLATION OF THE TRADES AND THERETURN OF HIS $1,000,000.00 PLUS INTEREST.

IRCLAIMS THAT ON HIS INITIAL PROPOSAL CUSTOMER HAD EXPRESSEDINTEREST IN A DAVIS NEW YORK FUND. IR DID NOT BELIEVE CUSTOMERWAS INTERESTED IN INVESTING THE ENTIRE AMOUNT INTO JUST THEPUTNAM FUNDS. THE IR`S RECOMMENDATIONS FOR THE CUSTOMER`SPORTFOLIO WERE SUITABLE AND HE DID EXPLAIN THE BREAKPOINTS TOTHE CUSTOMER AND SHOWED HIM THE APPLICABLE PAGE OF THEPROSPECTUS. CLAIM DENIED.NOT PROVIDED
