Allegations: CLIENT ALLEGED FAILURE TO FOLLOW INSTRUCTIONS. SHE EMAILED MS. GARCIA INSTRUCTIONS TO CLOSE THE ACCOUNT THREE HOURS AFTER THE MARKET CLOSED AND THEN COMPLAINED THAT SHE DID NOT RECEIVE THE CLOSING PRICES.

Broker Comment: COMMENT BY MS. GARCIA: THIS CLIENT IS MISTAKEN ON SEVERAL MATTERS. FIRST OF ALL, SHE BELIEVED THAT AS SOON AS SHE CLICKED ON THE "SEND" BUTTON ON HER COMPUTER, THAT HER EMAILED SELL ORDERS WERE RECEIVED AND PROCESSED. SHE HAD BEEN TOLD REPEATEDLY THAT THIS IS NOT THE CASE, AND SHE RESPONDED (IN WRITING) THAT SHE UNDERSTOOD. THIS IS CONTRADICTORY TO WHAT SHE IS NOW ALLEGING. EVERY EMAIL THAT I SEND HAS A DISCLAIMER REMINDING CLIENTS NOT TO EMAIL ORDERS AS WE CANNOT GUARANTEE TIMELY EXECUTION OR RECEPTION OF SUCH ORDERS. SECONDLY, SHE BELIEVED THAT THE CLOSING PRICE AND THE OPENING PRICE WERE IDENTICAL, WHICH IS NOT THE CASE. THIRDLY, SHE BELIEVED THAT SHE DIDN'T HAVE TO PAY COMMISSIONS FOR HER SELL ORDERS. SHE HAS KNOWN FOR 5 YEARS WHAT OUR COMMISSIONS ARE. THIS CLIENT MORE THAN DOUBLED HER MONEY IN LESS THAN 5 YEARS AND NOW THE CLIENT IS COMPLAINING BASED UPON ERRONEOUS ASSUMPTIONS REGARDING THE MARKET. THIS COMPLAINT IS COMPLETELY UNJUSTIFIED.

WHEN I EXPLAINEDTO THE ATTORNEY FOR PAINE WEBBER THE CIRCUMSTANCES, SHE SETTLEDWITH THE CUSTOMER IMMEDIATELY SINCE OUR ANALYST HAD IT RATED A#1 (BUY).
