THE CLIENT ALLEGES THE FINANCIAL ADVISOR ASSURED THEM THAT THIS WOULD MEET THEIR NEED AND TOLD THEM TO TRUST THEIR ATTORNEY.SHORTLY AFTER THE FREE LOOK PERIOD HAD EXPIRED, THEY WERE NOTIFIED BY THE NURSING HOME CARE PROVIDER THAT THEIR APPLICATION HAD BEEN DENIED. THE CLIENT INDICATES THE LACK OF $7,897.80, THE DIFFERENCE OF THE $27,000 AT THE END OF THE 5 YEAR PERIOD AS THE REASON FOR DENIAL. AFTER METLIFE, THE ANNUITY PROVIDER, SENT VARIOUS LETTERS TO THE NURSING CARE PROVIDER, THE APPLICATION REMAINED DENIED. THE CLIENT IS REQUESTING AN EXCEPTION TO ALLOW THE CONTRACT TO BE FREE LOOKED. Damage Amount Requested: $7,897.80 Broker Comment: AT THE INSTRUCTION OF THE CLIENT'S POA, THE FINANCIAL ADVISOR OBTAINED INSTRUCTION REGARDING THE ANNUITY PRODUCT PAYOUT ELECTION FROM THE CLIENT'S ATTORNEY. THE FINANCIAL ADVISOR PROVIDED TWO QUOTES FOR THE ATTORNEY'S REVIEW AND WAS INFORMED THE 5 YEAR PERIOD CERTAIN WITH LIFE WOULD MEET THEIR NEED. THE CONTRACT WAS REVIEWED WITH THE POA AND CLIENT AT DELIVERY WHERE THE FREE LOOK PERIOD WASDISCUSSED. THE FINANCIAL ADVISOR CONTACTED THE POA ONE DAY PRIOR TO THE FREE LOOK EXPIRATION AS A REMINDER, AND THE POA FELT CONFIDENT THE ATTORNEY WOULD BE ABLE TO WORK THROUGH THE DETAILS.AS A CLIENT SERVICE GESTURE, THE FIRM WORKED IN CONJUNCTION WITH THE ISSUING INSURANCE COMPANY, WHICH GRANTED AN EXCEPTION TO THE FREE LOOK EXPIRATION. ORIGINAL PREMIUM, MINUS ANY WITHDRAWALS WILL BE RETURNED TO THE CLIENT'S ACCOUNT.
