I WAS NOT FOUND TO BE IN ERROR IN THIS MATTER, BUT THE SETTLEMENT WAS THE LEAST COSTLY ROUTE FOR ALL PARTIES INVOLVED AND WAS SETTLED OUTSIDE OF ARBITRATION.
