THE [CUSTOMERS]DEPOSITED AROUND FOURTIMES THE TARGETDEPOSIT WHICH DEPENDENT ON THE RETURNS WOULDDETERMINE WHEN ANY FURTHER DEPOSITS WOULD BE NECESSARY. THEYRECEIVED A PROSPECTUS AND HIS SON, [FAMILY MEMBER], WASPRESENT ON SEVERALOF THE APPOINTMENTS.

THEY PAID THE MAXIMUMPREMIUM TO PREVENT THE POLICIES FROM BECOMING A MODIFIEDENDOWMENT. THE SECOND PREMIUM WAS PAID BEFORE THE ANNIVERSITYWHICH CREATED A MODIFIED ENDOWMENT. METLIFE STOPPED SENDINGSTATEMENTS TO AGENTS IN JAN. 1994 AND I DID NOT KNOW IT BECAMEA MEC. THE POLICY WAS DELIVERED AND ILLUSTRATIONS WERE GIVENAND EXPLAINED AT DELIVERY.

IN1994 [CUSTOMER] WISHED TO CHANGE FROM OPTION B TO OPTION A.METLIFE WOULD NOT HONOR THAT CHANGE UNTIL SECOND ANNIVERSARYAND [CUSTOMER] DID NOT WANT THE POLICY. MY SECRETARY SENTMONTHLY REPORTS TO [CUSTOMER]. I DID NOT MISLEAD HIM.
