Allegations: THE CLIENT ALLEGED HE ADAMANTLY SAID HE DID NOT WANT TO INVEST IN ANY IDS LIFE INSURANCE PROGRAMS, POLICIES OR ANY OTHER PLANS THAT REQUIRED LONG TERM INVOLVEMENTS THAT WOULD PENALIZE WITHDRAWALS OF HIS FUNDS. THE CLIENT ALSO ALLGED UNAUTHORIZED ACTIVITY WITH HIS ACCOUNTS BUT DID NOT PROVIDE SPECIFIC DETAILS. THE CLIENT PURCHASED HIS IDS LIFE FLEXIBLE ANNUITY ON JUNE 21, 1994. HE REQUESTED THE SURRENDER CHARGES ON HIS ACCOUNTS BE WAIVED.
Damage Amount Requested: $7,006.00
Broker Comment: THE FIRM FOUND I PROVIDED FULL AND FAIR DISCLOSURE OF THE ANNUITY CONTRACT THE CLIENT AGREED TO PURCHASE. THE CLIENT SIGNED AND INITIALED THE APPROPRIATE PAGES OF THE ANNUITY APPLICATION ACKNOWLEDGING HIS RECEIPT OF THE PROSPECTUS AND AGREEMENT WITH THE TERMS OF THE ANNUITY CONTRACT. FURTHER, THE CLIENT WAS UNABLE TO PROVIDE SPECIFIC DETAILS TO SUBSTANTIATE HIS CLAIM OF UNAUTHORIZED ACTIVITY WITHIN HIS ACCOUNTS. BSED ON PREVIOUS DISCUSSIONS WITH HIS REGISTERED REPRESENTATIVE, IT APPEARED THE CLIENT WAS SEEKING A WAY TO SURRENDER THIS ANNUITY CONTRACT, WITHOUT CHARGE, BECAUSE HE WAS DISATISFIED WITH THE RATE OF RETURN IT HAD EARNED. THE FIRM INFORMED THE CLIENT HIS REQUEST TO HAVE THE SURRENDER CHARGES WAIVED WAS DENIED AND SHOULD HE STILL SURRENDER THE ANNUITY CONTRACT, ANY APPLICABLE SURRENDER CHARGES WOULD BE ASSESSED.
