Settlement Amount: $27,263.40 Broker Comment: I DENY ANY AND ALL ALLEGATIONS, AND MY POSITION REMAINS THAT THE CLIENT HAD FULL KNOWLEDGE HIS CONTRACT WAS AN EQUI-VEST PRODUCT WITHOUT A 6% GMIB VERSUS AN ACCUMULATOR, WHICH IS NOT AVAILABLE FOR SEP, WITH THE GMIB. IN ADDITION, THE CLIENT MADE A SUBSEQUENT CONTRIBUTION TO HIS SEP WELL AFTER I LEFT AXA/EQUITABLE. I WOULD LIKE TO STATE THAT AT NO TIME DID I OR ANYBODY TAKE DISCRETIONARY AUTHORITY OVER THE INVESTMENT CHOICES. FOR THE RECORD, I WAS A 5% PARTICIPANT IN THE CASE, WAS NOT THE SERVICE AGENT, NOR DID I DO THE ACTUAL ENROLLMENT AND, AS PREVOIUSLY STATED, WAS NOT THERE WHEN A SUBSEQUENT SEP CONTRIBUTION WAS MADE. EQUITABLE HAS DECIDED ON THEIR OWN TO SETTLE THE CLAIM.
