THE CASE WAS TRANSFERRED TO THE UNITED STATES DISTRICT COURT FOR THE DISTRICT OF MASSACHUSETTS TO BE CONSOLIDATED WITH THE MDL CASE "IN RE MUTUAL LIFE INSURANCE COMPANY OF NEW YORK PREMIUM LITIGATION". THE CASES WERE TRANSFERRED ON AUGUST 20, 2003 AND THERE HAS BEEN NO ACTIVITY SINCE THAT TIME.
