Broker Comment: [CUSTOMER], TRUSTEE ALLEGES THAT I ADVISED HER TO PAY THE PREMIUMS ON A SURVIVORSHIP VARIABLE UNIVERSAL LIFE INSURANCE POLICY JUST TO MAKE A COMMISSION AND THAT I DID NOT EXPLAIN TO HER THAT THE PREMIUMS COULD INCREASE.THE POLICY WAS WRITTEN BY PRUDENTIAL AGENT [THIRD PARTY] IN 1997. IT WAS ASSIGNED TO ME AS THE SERVICING AGENT AFTER HIS DEATH IN 2008. PRUDENTIAL DOES NOT PAY RENEWAL COMMISSIONS ON A POLICY THAT IS ASSIGNED TO A SERVICING AGENT; THEREFORE THERE WAS NO INCENTIVE FOR ME TO ADVISE THAT THE PREMIUM BE PAID.I MET WITH [CUSTOMER] ON NOVEMBER 11, 2009, FOR THE FIRST TIME AT HER BUSINESS WHICH WAS 200 MILES FROM MY OFFICE. WE DISCUSSED THAT IT WAS A VARIABLE POLICY AND THAT THE PREMIUMS WERE NOT GUARANTEED AND THAT THE POLICY COULD LAPSE IF THE PREMIUMS WERE NOT PAID. HER FATHER HAD PASSED AWAY AND HER MOTHER WAS LIVING AND BASED ON THE SIZE OF THE ESTATE, SHE QUESTIONED THE NEED FOR THE POLICY. AS WE FINISHED OUR MEETING, I SUGGESTED THAT SHE TALK WITH HER ATTORNEY AND CPA TO SEE IF THEY FELT THAT SHE SHOULD PAY THE PREMIUMS. SHE AGREED TO DO THAT. [CUSTOMER] CALLED ME IN EARLY 2010 AS SHE HAD RECEIVED A PREMIUM NOTICE. I AGAIN ADVISED HER TO SEEK THE ADVICE OF HER ATTORNEY OR CPA ABOUT PAYING THE PREMIUM.I BEGAN MY PENSION WITH PRUDENTIAL ON MARCH 1, 2010, AND TERMINATED MY PRUDENTIAL CONTRACT ON JULY 16, 2010, AND I WAS NOT AWARE THAT [CUSTOMER] HAD PAID THE PREMIUM.AT NO TIME DID I SUGGEST OR RECOMMEND THAT [CUSTOMER] PAY THE PREMIUMS ON THIS POLICY.
