BECAUSE OF THIS IT CAUSED HIM APPROXIMATELY $10,730.00 IN LOSSES AND THE CLIENT FEELS HAD THE IR VERIFIED ALL THE INFORMATION HE WOULD HAVE NOT DONE THE LIQUIDATION. Damage Amount Requested: $10,730.00 Broker Comment: ACCORDING TO THE IR THE CLIENT WANTED TO LIQUIDATE HIS ANNUITY CONTRACT BECAUSE OF THE PERFORMANCE AND THE NEWS SURROUNDING PUTNAM. THE IR DISCUSSED THE CLIENTS OPTIONS BOTH WITH ALLSTATE AND THE CLIENT AND AFTER SEVERAL DISCUSSIONS THE CLIENT STILL WANTED TO LIQUIDATE HIS ANNUITY AND UNDERSTOOD THAT THERE WERE SURRENDER CHARGES. ACCORDING TO THE IR IT WAS NOT UNTIL AFTER THE POLICY WAS LIQUIDATED THAT THERE WAS A DISABILITY CLAUSE AND IT HAD TO BE EXERCISED BEFORE THE CONTRACT WAS LIQUIDATED. THE IR DID ATTEMPT TO GET AN EXCEPTION FROM ALLSTATE BUT THEY WOULD NOT GRANT HIM THIS EXCEPTION. WHEN THE CLIENT PRESENTED HIM WITH THE 1099 HE WORKED WITH HIS CPA TO HAVE A LETTER ATTACHED WITH HIS TAXES AND THE CLIENT DEMANDED A GUARANTEE AND THE CPA WAS NOT WILLING TO PROVIDE HIM THIS GUARANTEE. BASED UPON OUR RESEARCH IT APPEARS THE CLEINT HAD THE NECESSARY INFORMATION TO MAKE AN INFORMED DECISION. COMPLAINT DENIED.
