THE CLIENT CLAIMS THAT THE BOND FUND WAS NOT SUITABLE FOR HER, AND SHE ALLEGES LOSSES OF APPROXIMATELY $48,600.00. Damage Amount Requested: $46,600.00 Settlement Amount: $36,377.13 Broker Comment: THE FIRM DETERMINED THAT THE SALE OF THE AIM HIGH YEILD FUND TO THIS PARTICULAR CLIENT WAS NOT SUTIABLE, AND THE CLIENT WAS OFFERED REIMBURSEMENT FOR THE LOSSES SHE SUFFERED IN THIS FUND. THIS AMOUNT WAS ADJUSTED FOR THE DIVIDENDS SHE RECEIVED FROM THE AIM HIGH YEILD FUND AND THE INTREST SHE WOULD HAVE RECEIVED IF SHE HAD REMAINED IN THE ORIGINAL BANK CD'S. IT WAS DETERMINED THAT THE CLIENT HAD RECEIVED DISCLOSURE OF THE CHARATERISTICS OF THIS MUTUAL FUND, BUT A FUND OF THIS TYPE SHOULD NOT HAVE BEEN RECOMMENDED TO THIS CLIENT.
