Broker Comment: THERE IS NO MERIT WHATSOEVER TO THE CUSTOMER'S CLAIM. THE CUSTOMER DID NOT GIVE AN ORDER TO EXERCISE. WHEN HE SAW THE MARKET FOR THE STOCK SUBSEQUENTLY RISE, HE CLAIMED HE ENTERED THE ORDER. THE CUSTOMER TOOK NO MARKET ACTION CONSISTENT WITH AN ALLEGED INTENT TO BUY AND HOLD THE STOCK. CUSTOMER SEEKS CONJECTURAL DAMAGES OF THE DIFFERENCE BETWEEN THE EXERCISE PRICE AND CURRENT MARKET PRICE, YET HE NEVER PURCHASED THE STOCK AND ASSUMED MARKET RISK. WITH RESPECT TO THE FAILURE TO SUPERVISE CLAIM, THE STATE CLAIM CONTAINS NO FACTUAL ALLEGATIONS WHICH WOULD SUPPORT SUCH A CLAIM. THE GRAVAMEN OF THE CLAIM IS THAT MERRILL LYNCH WOULD NOT SELL ORDER GIVEN BY THE CUSTOMER AFTER HE CHANGED HIS MIND WHEN HE SAW THE MARKET PRICE OF THE SECURITY RISE. CLAIM VOLUNTARILY DISMISSED WITH PREJUDICE AGAINST MR. GRIMALDI. PARTIES ARE SEEKING EXPUNGEMENT.
