Category: Customer Dispute
Allegations: In September 2012, the Purdon's completed paperwork with RR Carlgren to purchase several Bankers Life and Casualty Company fixed annuities. The Purdon's allege that: 1. They were instructed to sign incomplete forms and signatures from these forms was copied and used to produce additional contracts; 2. Bankers Life and Casualty failed to maintain their funds in a fiduciary manner; 3. Deceptive and fraudulent methods were used to induce the sale of a security and induce the purchase of an annuity.
Damage Amount Requested: $6,995.90
Settlement Amount: $6,955.90
Broker Comment: Bankers Life and Casualty Company investigated the allegations of the complaint, including a review of the documents that were submitted with the sales and reviewed RR Carlgen's statements. The investigation does not support the allegations of mishandling of funds or misrepresentation. To the contrary, the documents reflect that the sales were suitable and reasonable in light of the Purdons' financial status, goals and objectives. Specifically, the annuities addressed the Purdons' concerns about protecting a portion of their retirement assets from stock market risk and generating a monthly income that they would not outlive. That said, because RR Carlgren has acknowledged that the Purdons signed some, but not all of the documents, BLC agreed to refund the surrender charges that the Purdons incurred when they surrendered their annuities and to return the remaining payment on two annuitized annuities. The FA was suspended for 30 days by the firm starting Sep 1-30, 2017
