WAGNER COMMENTS: I INVESTED A PORTION OF THE CLIENT'S PORTFOLIO IN ESTATE NOTES WITH THE CLIENT'S APPROVAL. THE CLIENT ADVISED ME THAT THE MONEY INVESTED IN THE ESTATE NOTES WOULD NOT BE USED OR NEEDED BY THE CLIENT. THESE FUNDS WOULD BE TRANSFERRED TO THE BENEFICIARIES OF THE TRUST UPON THE DEATH OF THE CLIENT. THE "ESTATE FEATURE" CONTAINED IN THE NOTES, ALLOWS THE BENEFICIARIES TO RECEIVE THE FULL VALUE OF THE NOTES UPON THE DEATH OF THE OWNER. THE CLIENT WAS ALSO INFORMED OF ALL RISKS ASSOCIATED WITH THE ESTATE NOTES PRIOR TO INVESTING.. I LEFT WAMU INVESTMENTS IN NOVEMBER 2008 TO ACCEPT A NEW JOB AT ANOTHER FIRM AND I AM NOT AWARE OF WHAT TRANSACTIONS TOOK PLACE IN THE [CUSTOMER] TRUST ACCOUNT SINCE MY DEPARTURE. IT HAS BEEN OVER 2 YEARS AND 6 MONTHS SINCE I HAVE WORKED FOR WAMU INVESTMENTS WHICH IS NOW OWNED BY CHASE. IT IS MY BELIEF THAT THE CLIENT VOIDED THE "ESTATE FEATURE" CONTAINED WITHIN THE NOTES BY TRANSFERRING THE ACCOUNT TO ANOTHER FIRM OR BY SELLING THE NOTES PREMATURELY AT THE ADVISE OF ANOTHER ADVISOR. Damage Amount Requested: $149,375.00
