THE CLAIM ASSERTS A BREACH OF FIDUCIARY DUTY BY THE REGISTERED REPRESENTATIVE BASED ON MESIROW FINANCIAL FOLLOWING THE WRITTEN INSTRUCTIONS OF A CO-TRUSTEE WITH FULL INVESTMENT AND TRADING AUTHORITY, OVER A TEN-YEAR PERIOD FROM 2004 TO 2014. SPECIFICALLY, THE COMPLAINT ALLEGES THAT THE REGISTERED REPRESENTATIVE BREACHED AN ALLEGED FIDUCIARY DUTY BY FOLLOWING THE DIRECTION OF A CO-TRUSTEE TO ESTABLISH AND MAINTAIN MARGIN LOANS AND BY EXECUTING REQUESTS TO WITHDRAW FUNDS FOR INVESTMENTS AWAY FROM MESIROW FINANCIAL INC. THE REGISTERED REPRESENTATIVE BELIEVES THE CLAIMS ARE TOTALLY WITHOUT MERIT AND INTENDS TO FULLY REFUTE THEM AT THE ARBITRATION HEARING.
