Date: July 10, 2002 Category: Customer Dispute Allegations: THE CLIENT ALLEGES HE HAD NO RECOLLECTION OF SETTING UP A QUALIFIED ANNUITY AND NOW WANTS TO SURRENDER POLICY WITH OUT PENALTY. ALSO WANTS TO SURRENDER TWO NON QUALIFIED POLICIES. Settlement Amount: $190,000.00 Broker Comment: I WAS INVOLVED IN AN E&O CLAIM WITH A CLIENT WHO PURCHASED VA IN 1997 AND 1998 TO FUND CHARITABLE REMAINDER TRUSTS. AFTER MULTIPLE UNSCHEDULED WITHDRAWALS AND THE MAKET DOWNTURN THE CLIENT DECIDED THE TRUST WERE NOT A GOOD IDEA. WANTED TO TERMINATE THE TRUSTS AND VA POLICIES WITHOUT INCURRING SURRENDER FEES. ALLMERICA FINANCIAL AND E&O CARRIER DID NOT BELIEVE SUCH ACTION WAS WARRANTED AND REFUSED TO WAIVE SURRENDER FEES. TO SETTLE THE LAWSUIT, THE E&O CARRIER SETTLED OUT OF COURT IN 2004. IN MY 39 PLUS YEARS, THIS IS THE ONLY COMPLAINT AGAINST ME FOR MY CONDUCT OR RECOMMENDATIONS RELATED TO MY SECURITIES BUSINESS.
