Date: October 17, 2008 Category: Financial Type: Bankruptcy Disposition: Direct Payment Procedure Broker Comment: SHORTLY AFTER MY DEPARTURE FROM EKN FINANCIAL (EKN) AT THE END OF 2005, EKN FILED A $2,000,000.00 LAWSUIT. THE LAWSUIT ALLEGED THAT I WAS IN BREACH OF CONTRACT THAT I WAS FORCED TO SIGN WHILE I WAS EMPLOYED AT EKN. THE DAMAGE AMOUNT SOUGHT BY EKN WAS TO RECOVER THE LOST FUTURE REVENUES. THE EMOTIONAL AND FINANCIAL STRAIN PUT ON ME AND MY FAMILY DUE TO THE FIGHTING OF THE LAWSUIT WAS OVERWHELMING. THIS CAUSED ME TO LAPSE ON MY FINANCIAL OBLIGATIONS, SO TOWARDS THE END OF 2008, AT THE ADVICE OF COUNSEL I DECLARED BANKRUPTCY TO PROTECT ME AND MY FAMILY AGAINST THE LAWSUIT FROM EKN. ONCE THE BANKRUPTCY WAS FILED, EKN SETTLED THE PENDING LAWSUIT FOR A MERE $25,000.00. BUT STRAIN OF THIS DARK CLOUD OVER MY FAMILY CAUSED ME TO FALL BEHIND IN MY OBLIGATION TO THE US GOVERNMENT. SO ONCE I SETTLED WITH EKN, I SETTLED WITH THE GOVERNMENT TO PAY MY OUTSTANDING BALANCE. I MADE THIS DECISION TO PROTECT ME AND MY FOUR CHILDREN AND MY GOAL IS TO PAY OFF THE OUTSTANDING DEBT AS SOON AS POSSIBLE AND MOVE FORWARD WITH MY LIFE.
