Allegations: CLIENT ALLEGES THAT HER FINANCIAL CONSULTANT SOLD SHARES IN HER ACCOUNT WITHOUT PRIOR AUTHORIZATION. FURTHERMORE, CLIENT ALLEGES THAT IN AN ATTEMPT TO CORRECT THE AFROEMENTIONED SAFE, THE FINANCIAL COUNSULTANT PURCHASED THE SHARES USING AN INCORRECT ACCOUNT.

Broker Comment: THE FINANCIAL CONSULTANT MET WITH BOTH THE CLIENT AND HER C.P.A. REGARDING THE SHARES AT ISSUE. AT THIS MEETING IT WAS JOINTLY DECIDED THAT ONCE THE SHARES WERE TRANSFERRED TO MERRILL LYNCH THEY WOULD BE SOLD, EXCEPT FOR 500 SHARES. ONCE THE SHARES WERE ACTUALLY TRANSFERRED TO MERRILL LYNCH, THE FINANCIAL CONSULTANT WAS INSTRUCTED TO SELL ALL OF THE SHAERES AT THE MARKET, EXCEPT 500 SHARES, AND HAVE THE PROCEEDS SWEEP INTO A MONEY MARKET. AS SUCH, ALL TRANSACTIONS WERE THE RESULT OF DIRECT INSTRUCTIONS BY THE CLIENT.
