BRANCH MANAGEMENT HAD ASSIGNED THE ACCOUNT TO ME PENDING ITS TRANSFER TO ANOTHER FIRM. THE MARGIN DEPARTMENT ADVISED ME THAT AN EXISTING UNCOVERED SHORT POSITION IN THIS FOREIGN SECURITY COULD NOT TRANSFER OUT AND EITHER HAD TO BE COVERED OR THE ELECTRONIC TRANSFER HAD TO BE CANCELED. I THEN COVERED THE SHORT POSITION ONLY AFTER SPEAKING WITH AND OBTAINING AUTHORIZATION FROM THE HOLDER OF TRADING AUTHORITY FOR THE ACCOUNT.

NEITHER BEAR STEARNS NOR I SHOULD HAVE BEEN HELD LIABLE FOR RESPECTING THE DURABLE POWER OF ATTORNEY EXECUTED BY THE CUSTOMER IN FAVOR OF HER SON. ACCORDINGLY, WHILE I FULLY ACKNOWLEDGE THE AUTHORITY OF THE PANEL TO RENDER THE AWARD IT DID, I STRONGLY DISAGREED (AND CONTINUE TO DISAGREE) WITH ITS CONCLUSION.
