Damage Amount Requested: $310,493.00 Settlement Amount: $110,000.00 Broker Comment: DESPITE THE FACT THAT I DID NOT ENGAGE IN ANY WRONGDOING AND INTENDED TO VIGOROUSLY DEFEND AGAINST THE ALLEGATIONS, MY FORMER BROKERAGE FIRM ELECTED TO SETTLE THESE CLAIMS IN ORDER TO AVOID FURTHER LITIGATION COSTS AND THE POTENTIAL OF AN ADVERSE AWARD. THE CLAIMANTS FATHER WAS THE TRUSTEE OF THE DAUGHTER'S TRUST ACCOUNT. AS THE TRUSTEE, HE WAS GIVEN COMPLETE CONTROL OF FUNDS. HE TOLD ME HIS DAUGHTER WAS VERY SICK AND HE NEEDED THE MONEY TO TAKE CARE OF HER AND ASKED ME TO LIQUIDATE FUNDS FROM THE TRUST'S FUNDS. I FOLLOWED THE TRUSTEE/FATHER'S ORDERS. ACCORDING TO THE CLAIMANT, HE WAS USING THE MONEY FOR PERSONAL REASONS AND NOT TO TAKE CARE OF HIS DAUGHTER.
