HE WAS FOUND NOT GUILTY AND THE CHARGE DISMISSED. WE HAVE DOCUMENTATION ON FILE THAT SUBSTANTIATES THAT THIS IS AN EVENT THAT SHOULD NEVER HAVE BEEN DISCLOSED ON THE RR'S FORM U-4. WE ARE ADDING THIS BACK INTO THE U-4 BASED ON THE DISCLOSURE REVIEW DONE BY FINRA BUT WE DISAGREE THAT THIS IS DISCLOSEABLE AS THIS WAS NOT AN INVESTMENT RELATED CRIME. IT WAS A $60 CHECK THAT WAS RETURNED FOR INSUFFICIENT FUNDS. WE WILL ADVISE THE RR TO CONTEST THIS WITH FINRA.
