Date: January 21, 2004
Category: Customer Dispute
Allegations: CUSTOMER ALLEGED THAT INSTEAD OF HER ASSETS BEING LIQUIDATED FROM HER MANAGED ACCOUNTS AT NO COST, HER HOLDINGS WERE REMOVED FROM THE MANAGED ACCOUNTS AND MOVED TO HER NON MANAGED ACCOUNT AND SOLD IN DECEMBER 2003, CAUSING A COMMISSION CHARGE OF $7,130.15. COMMISSION CHARGES HAVE BEEN REVERSED.
Damage Amount Requested: $7,130.15
Settlement Amount: $7,130.15
Broker Comment: I STRONGLY DISAGREE WITH THE FIRM'S INTERPRETATION THAT THE CUSTOMER'S LETTER IS A COMPLAINT. MY POSITION IS THAT I WAS FOLLOWING THE CUSTOMER'S WRITTEN INSTRUCTIONS TO SELL THE SECURITY POSITIONS IN HER ACCOUNTS. THE CUSTOMER SUBSEQUENTLY PROVIDED ME WITH A WRITTEN ACKNOWLEDGEMENT THAT HER DEMAND WAS FOR A COMMISSION ADJUSTMENT, AND NOT AN ALLEGATION OF ANY IMPROPRIETY. THE CUSTOMER RECEIVED THE COMMISSION ADJUSTMENT, AND DID NOT RECEIVE ANY OTHER COMPENSATION.
