Allegations: [Customer] alleges that Mr. Imper misrepresented the features and liquidity of a Tax Qualified Single Premium Immediate Annuity ("SPIA") issued by Bankers Life and Casualty Company, which [Customer] funded with certain proceeds from her Stifel, Nicolaus & Company, Inc. brokerage IRA ("Stifel IRA") . [Customer] alleges that Mr. Imper represented that the SPIA would provide her liquidity similar to her Stifel IRA. [Customer] alleges that when she attempted to access additional funds from the SPIA was not able do so. [Customer] alleges that she attempted to contact Mr. Imper, but that Mr. Imper did not respond

Broker Comment: [Customer] was referred to - [Third Party] by Mr. Robert Imper, both are agents of Bankers Life and Casualty Company. [Third Party] contacted [Customer] to discuss her financial goals and reviewed [Customer's] income and assets, including the holding's of [Customer's] Stifel IRA. [Third Party] advised [Customer] that the monthly distribution she received from the Stifel IRA (approximately $380) was less than she could obtain from the SPIA (approximately $932). As income was of great importance to [Customer], as was minimizing market risk and losses, [Third Party] recommended that [Customer] use certain proceeds from the Stifel IRA to purchase the SPIA and secure lifetime income, free of market risk. [Third Party] also recommended that [Customer] leave approximately $33K in the Stifel IRA for extra/emergency liquidity. This transaction was reviewed and found to be suitable by both Bankers Life and Casualty Company and Bankers Life Securities, Inc. Bankers Life and Casualty Company deemed [Customer's] complaint to be without merit and accordingly denied any claim for reimbursement or voiding of the SPIA.
