THE CLIENT STATES ON OR ABOUT 2/20/00 THE CLIENT INQUIRED AS TO WHAT PRICE HE HAD PURCHASED CELN. THE CLIENT STATES MR. LEMNUS HAD NOT ACQUIRED THE STOCK BECAUSE THE STOCK HAD RISEN AFTER THE ORDER WAS RECEIVED. THE CLIENT STATES HE DID NOT INSTRUCT MR. LEMNUS TO ENTER A LIMIT ORDER. Damage Amount Requested: $5,000.00 Broker Comment: THE CUSTOMER'S ATTORNEY WAS ADVISED THAT THE IR CLAIMS THE INVESTMENT IN QUESTION WAS A BULLETIN BOARD STOCK AND HE COULD NOT OBTAIN A CURRENT QUOTE ON THAT STOCK. THE IR INDICATES THAT HE HAD THE CLOSING PRICE FOR THE PREVIOUS DAY AND AFTER SOME DISCUSSION THE CUSTOMER AGREED THAT AN ORDER FOR 3,250 SHARES AT $3.00 PER SHARE WOULD BE ENTERED FOR THE STOCK. THE CUSTOMER HAD PREVIOUSLY INDICATED HE WANTED TO USE THE FUNDS FROM THE LIQUIDATION OF ANOTHER INVESTMENT TO PAY FOR THE TRADE. THE POSITION OFOUR FIRM IS THAT THE CUSTOMER AGREED THAT THE ORDER WOULD BE ENTERED AT A SPECIFIC PRICE PER SHARE AND THE IR FOLLOWED HIS INSTRUCTIONS. THE CLAIM IS DENIED.
