ON 09/25/14 THE DELAWARE COURT TRANSFERRED TO US DISTRICT COURT IN IDAHO. ON 02/06/15, THE IDAHO COURT DECLINED TO EXERCISE JURISDICTION OVER PLANTIFF'S STATE LAW CLAIMS AND DISMISSED WITHOUT PREJUDICE. ON 3/9/15, PLAINTIFF FILED COMPLAINT AND DEMAND FOR JURY TRIAL IN US DIST CT IN IDAHO. CASE NO. 1:15-CV-80-EJL. On 12-4-15, Case No. 1:15-CV-80-EJL was Stayed pending Arbitration. Claimants then moved the issue to arbitration case no. 16-00971. The civil case is technically still pending until arbitration is done. 12-24-16 - settlement agreement signed. Rep denies and will continue to deny claims however to avoid the time, expense, and risk of further litigation the parties settled their claims.//Updating DRP to reflect settlement of arbitration which also closes the stayed civil case.
