SEEKS RETURN OF CPA FEE TO BE INCURRED FROM PROBATE AS WELL AS FOR TAX LIABILITY FROM DISTRIBUTION. NO SPECIFIC DAMAGES ALLEGED.

Allegations: CLIENT BELIEVES SINGLE PREMIUM IMMEDIATE ANNUITY (SPIA) PURCHASED 9/23/04 WAS NOT SUITABLE. NO SPECIFIED DAMAGES ALLEGED.
Broker Comment: CLIENT HAD BEEN ADVISED BY A COMPETITOR THAT IF HE INVESTED HIS $60,000 IN AN IMMEDIATE ANNUITY IT WOULD "GUARANTEE HIM A MONTHLY INCOME OF OVER $700 FOR LIFE". SINCE HE INDICATED THAT STABILITY OF INCOME FOR LIFE WAS A TOP PRIORITY, I SUGGESTED HE INVEST NO MORE THAN HALF ($30,000) AND KEEP THE REMAINDER LIQUID. WE DISCUSSED THE DIFFERENCE BETWEEN "LIFE" AND "LIFE WITH 10 YEAR GUARANTEE" AT LENGTH. HIS DESIRE WAS FOR THE ADDITIONAL $60/MONTH THAT THE LIFE OPTION OFFERED. I EXPLAINED THERE WOULD BE NO BENEFIT TO HIS CHILDREN IF HE DIED AND HIS WORDS WERE, "I DON'T NEED TO LEAVE ANYTHING TO THEM AND THERE'S ALWAYS THE OTHER $30,000 THEY COULD HAVE". I WAS NOT AWARE AT THE TIME HE WAS ANGRY WITH THEM AND THEY HAVE SINCE RECONCILED. CLIENT DID NOT DISCLOSE TO ME THAT HE HAD HAD CANCER 16 YEARS AGO. THE CANCER HAS NOW COME BACK AND IS THE REASON BEHIND HIS DESIRE TO SURRENDER THE CONTRACT. I HAVE CONTACTED SEVERAL INDIVIDUALS AND DEPARTMENTS AT THE ISSUING COMPANY AND HAVE BEEN GIVEN THE SAME ANSWER: PER THE CONTRACT, NO CASH SURRENDERS ARE AVAILABLE. CLIENT ALSO CLAIMS TO HAVE NEVER RECEIVED THE ORIGINAL POLICY. IT WAS RECEIVED IN OUR OFFICE AND FORWARDED TO HIM ON 10/4/04, WITH A COVER LETTER THAT SPECIFICALLY STATED TO CONTACT US WITHIN THE 10-DAY FREE LOOK PERIOD IF FOR ANY REASON HE WAS NOT SATISFIED. WE WERE NOT CONTACTED.
