THEIR ACKNOWLEDGED INVESTMENT OBJECTIVES AND STATED RISK TOLERANCES DEMONSTRATED THE CLAIMANTS WERE FAMILIAR WITH THE PURCHASED REIT. THEY PREVIOUSLY PURCHASED REITS ON THREE SEPARATE OCCASIONS, FOR WHICH THE CLAIMANT RECEIVED THEIR INITIAL INVESTMENT MONIES BACK AS WELL AS DIVIDENDS AND GAINS. AT EACH REIT PURCHASE, DISCLOSURE FORMS WERE SIGNED AND CLAIMANT CERTIFIED NUMEROUS TIMES IN WRITING THAT THEY WERE BASING THEIR INVESTMENT DECISIONS ON THEIR INDEPENDENT REVIEW OF THE SPONSORS' OFFERING DOCUMENTS. AS OF THE TIME OF THE CLAIM THEY HAD SUSTAINED NO LOSS AND WERE STILL RECEIVING INCOME FROM THE REIT. DUE TO THE EXPENSE OF PROLONGED ARBITRATION, PROTECTED INVESTORS OF AMERICA AND RR CHOSE TO SETTLE RATHER THAN CONTINUE THE DISPUTE.
