Damage Amount Requested: $158,175.00 Settlement Amount: $38,000.00 Broker Comment: DEFENDANTS MERRILL LYNCH AND MYSELF FILED THE CASFOR $38,000.00, OF WHICH I CONTRIBUTED $30,000.00.MERRILL LYNCH AND PERLIN BELIEVE THEY HAD GOODDEFENSES TO THE COMPLAINT. PLAINTIFF HAD AN ACCOUNT WITH PERLIN,WHICH WAS EXTREMELY PROFITABLE OVERALL, FOR NEARLY TWENTY YEARS.BOTH HIS ACCOUNTANT AND INVESTMENT ADVISORS RECEIVED DUPLICATECONFIRMATIONS OF EVERY TRADE, AS WELL AS STATEMENTS. NOCOMPLAINT WAS EVER MADE UNTIL WELL AFTER THE ACCOUNT CLOSED.HOWEVER, BECAUSE OF THE ANTICIPATED COST OF LITIGATION,DEFENDANTS AGREED TO SETTLE.
