ARBELAEZ, HE UNDERSTOOD HIS INVESTMENT TO BE IN A GUARANTEED FUND IN THE UNITED STATES, RATHER THAN IN THE ESFIL COMMERCIAL PAPER PRODUCT. THE CUSTOMER FIRST AGREED TO PURCHASE THE ESFIL COMMERCIAL PAPER ON OCTOBER 14, 2013. ON OCTOBER 15, 2013, MR. ARBELAEZ PROVIDED THE CUSTOMER WITH THE INFORMATION MEMORANDUM, DISCLOSURE FORM AND ONLINE ACCESS REQUEST FORM. THE CLIENT RETURNED THE EXECUTED DOCUMENTS TO MR. ARBELAEZ ON OCTOBER 29, 2013. ON NOVEMBER 5, 2013, MR. ARBELAEZ ADVISED THE CLIENT OF A LOWER INTEREST RATE AND CONFIRMED THE PURCHASE OF THE COMMERCIAL PAPER. ON NOVEMBER 8, 2013, THE PURCHASE WAS EXECUTED FOR THE CLIENT. THE CLIENT SENT THE COMPLAINT FOLLOWING RECEIPT OF NEWS CONCERNING THE POSSIBLE INABILITY OF ESFIL TO MAKE PAYMENTS REQUIRED UNDER THE PAPER. Damage Amount Requested: $500,000.00
