Allegations: CUSTOMER ALLEGED THAT THE REPRESENTATIVE MISREPRESENTED THE GUARANTEED INTEREST RATE ON TWO VARIABLE ANNUITIES ISSUED IN DECEMBER 2005 AND MARCH 2006. NO SPECIFIC COMPENSATORY DAMAGES WERE ALLEGED.
Broker Comment: ON JULY 15, 2011 I RECEIVED A PHONE CALL FROM MY COMPLIANCE DEPARTMENT AT MTL EQUITY PRODUCTS, INC. STATING METLIFE HAD RECEIVED A COMPLAINT FROM [CUSTOMERS] ABOUT SOME VARIABLE ANNUITIES I HAD SOLD THEM ON DECEMBER 30, 2005 AND MARCH 10, 2006. THE ALLEGATION BEING MADE AGAINST ME IS THAT THE VARIABLE ANNUITY POLICIES I SOLD TO [CUSTOMERS] ARE NOT MAKING THE 5% GUARANTEED INTEREST. THE [CUSTOMERS] STATE THAT THIS WAS BROUGHT TO THEIR ATTENTION BY [OTHER FIRM EMPLOYEE], AN AGENT WITH METLIFE IN MADISON, WI. (JULY 15, 2011 9:08 A.M.) AFTER FINDING OUT ABOUT THE FILED COMPLAINT MADE BY THE [CUSTOMER] I CALLED THE MANAGING PARTNER AT METLIFE SECURITIES IN MADISON, WI. [SUPERVISOR], MY FORMER SUPERVISOR STATED HE DID NOT REMEMBER ANY COMPLAINTS FILED AGAINST ME. HE TOLD ME TO COTACT [CASE MANAGER], THE COMPLIANCE CASE MANANGER FOR METLIFE SECURITIES IN THE STATE OF WI. I CALLED AND LEFT HER A MESSAGE. AS I WAS HANGING UP AT 9:10 A.M. MY PHONE RANG, IT WAS [SUPERVISOR]. [SUPERVISOR] STATED, "I NOW REMEMBER THAT I HAVE RECEIVED A COMPLAINT ABOUT YOU". HE STATED, "MY EMPLOYEE, [OTHER FIRM EMPLOYEE] (AT METLIFE SECURITIES IN MADISON, WI) RECENTLY SAW A CUSTOMER OF YOURS, [CUSTOMERS]". [CUSTOMER] AND [OTHER FIRM EMPLOYEE] HAD A DISCUSSION ABOUT THE VARIABLE ANNUITIES I HAD SOLD THEM ON THE DATES LISTED ABOVE. IT APPEARS FROM THAT CONVERSATION THAT [CUSTOMER] DID NOT REMEMBER HOW THE FEATURES AND BENEFITS OF THE VARIABLE ANNUITY WITH THE RIDER (GWB) GUARANTEED WITHDRAWL BENEFIT WORK. [SUPERVISOR] THEN STATED HE WAS ASKED BY [OTHER FIRM EMPLOYEE] TO GO TO THE NEXT APPOINTMENT WITH THE [CUSTOMERS].(JULY 18, 2011 2:48 P.M.) I RECEIVED A RETURN PHONE CALL FROM [SUPERVISOR], IT APPEARED BY THE SOUND, THAT HE HAD SOMEONE IN HIS OFFICE; I ASSUME IT WAS [OTHER FIRM EMPLOYEE]. [SUPERVISOR] STATED THAT HE HAD VISITED THE [CUSTOMERS] WITH [OTHER FIRM EMPLOYEE] AND HE TOLD [CUSTOMERS] TO WRITE A COMPLAINT LETTER TO METLIFE TO EXPLAIN WHAT THEIR SPECIFIC COMPLAINT WAS. [SUPERVISOR] ALSO STATED THAT HE COULD NOT ADDRESS THE PROBLEM BUT HE ENCOURAGED THEM TO WRITE THE LETTER. HE THEN STATED, "MY ADVICE TO YOU IS TO RESPOND TO THEIR WRITTEN COMPLAINT AND MAYBE IT IS JUST A MISUNDERSTANDING". ON THE CLIENTS SMALL HAND WRITTEN NOTE THEY STATE THAT THE ACCOUNT IS NOT MAKING THE 5% GUARANTEED INTEREST RATE THEY THOUGHT IT WAS SUPPOSED TO AND THAT IT WAS BROUGHT TO THEIR ATTENNTION BY [OTHER FIRM EMPLOYEE] OF METLIFE.
