MY ONLY CONTACT WITH THE CLIENT WAS ONE OF THE INITIAL MEETINGS IN WHICH I HELPED EXPLAIN TO THE WASKOWS HOW HER PENSION OFFERED A PARTIAL LUMP SUM OPTION, AND THE DIFFERENT JOINT & SURVIVOR OPTIONS THAT SHE HAD TO CHOOSE FROM. IN DISCUSSING THE LUMP SUM, WE ONLY DISCUSSED INVESTMENTS IN GENERAL, SPENDING MOST OF OUR TIME ON THE DIFFERENCE BETWEEN MUTUAL FUNDS AND VARIABLE ANNUITIES. THERE WAS NO SPECIFIC RECOMMENDATION MADE WHATSOEVER. THE WASKOWS WERE REFERRED BY DAVE WORLEY TO PENSION ADVISORS AND JOHN BROOKS OVER A MONTH LATER, AND THEIR COMPLAINT REVOLVED AROUND WHAT WAS RECOMMENDED AND IMPLEMENTED FROM THAT MEETING FORWARD.I WAS NOT A PARTICIPANT IN ANY FURTHER MEETING, NOR WAS I INCLUDED ON ANY CODING OF COMMISSIONS ON THE PRODUCTS IMPLEMENTED FOR THE WASKOWS. AS FOR THE COMPLAINT, THE CURRENT STATUS THAT I WAS MADE AWARE OF IS AS FOLLOWS: THE WASKOWS MET WITH SEVERAL REPS INVOLVED ON THE CASE, ALONG WITH LEGAL REPRESENTATION FROM BOTH SIDES. IT IS MY UNDERSTANDING THAT NO LAWSUIT WILL BE BROUGHT, AND THAT THE CLIENTS ARE CONSIDERING CONTINUING WITH THE PLAN ORIGINALLY RECOMMENDED BY OUR OTHER REPS.
