AT THE TIME, THE ATTORNEY IN FACT INDICATED THAT HE WANTED TO USE THE ACCOUNT'S MARGIN PRIVILEGES, RATHER THAN LIQUIDATE ITS SECURITIES, SO THAT THE CLIENT COULD CONTINUE TO TAKE ADVANTAGE OF THE THEN-RISING STOCK MARKET. IN ADDITION, THE ADVISOR FULLY DISCLOSED THE RISKS AND FEES ASSOCIATED WITH THE CLIENT'S MUTUAL FUNDS BOTH BEFORE AND AFTER THE ATTORNEY IN FACT MADE THE INVESTMENTS. ALTHOUGH IT WAS THE ADVISOR'S UNDERSTANDING THAT THESE INVESTMENTS WERE TO SERVE THE CLIENT'S INVESTMENT HORIZON OF UP TO 5 YEARS, THE ATTORNEY IN FACT SOLD THEM AT A LOSS AFTER ONLY 16 MONTHS.
