Allegations: CLIENT STATES THAT IR RECOMMENDED CLIENT BUY 100 SHARES OF WORLDCOM AT 47.75 AND THE PURCHASE TOOK PLACE ON JANUARY 6 OR 7, 2000. CLIENT ALLEGES SHE WANTED TO SELL SOME OF THE STOCK (DOES NOT SPECIFICY DATE) AND CLAIMS IR REFUSED. CLIENT FURTHER STATES THAT IR PERSUADED HER TO PURCHASE ADDITIONAL 100 SHARES AT 19 55/64 ON NOVEMBER 1, 2000. CLIENT ALSO STATES THAT IR TOLD HER IT WAS NOT HIS STRATEGY TO BUY AND SELL STOCK, BUT TO BUY AND HOLD. ON FEBRUARY 7, 2002, CLIENT RECEIVED A LETTER FROM THE FIRM STATING THAT THE WORLDCOM STOCK WAS NOW AT $9.85 AND SUGGESTING SHE STILL HOLD. CLIENT ALLEGES SHE MET WITH IR ON JULY 5, 2002, AND IR STATED THEY SHOULD SELL THE STOCK AND USE IT AS A TAX LOSS OR WAIT AND SEE WHAT HAPPENS. CLIENT FEELS THAT IR SHOULD HAVE CONTACTED HER WHEN STOCK WAS DROPPING. NO SPECIFIC CLAIM BUT POTENTIAL LOSSES MAY EXCEED $5,000.

Broker Comment: IR STATED THAT HE TOLD CLIENT HE WOULD PLACE THE ORDER TO SELL WORLDCOM HOWEVER, WANTED TO DISCUSS THE POSSIBILITY OF HOLDING THE SHARES. AFTER DISCUSSING THE OUTLOOK OF WORLDCOM (AT THAT TIME THERE WAS A BUY RECOMMENDATION), CLIENT DECIDED TO HOLD THE SHARES AND PURCHASE AN ADDITION 100 SHARES. THIS REPRESENTED APPROXIMATELY 3.4% OF NET WORTH. A LETTER WAS SENT TO CLIENT ON 2/7/02 AND AGAIN ON 4/24/02 REGARDING THE OPINION CHANGES ON WORLDCOM WITH AN OFFER FOR THE CLIENT TO CONTACT IR ABOUT HER INVESTMENT IN THE COMPANY. APPEARS THAT CLIENT WAS CONTACTED AS EVENTS BEGAN TO UNFOLD REGARDING WORLDCOM AND THAT IR DID NOT REFUSE TO SELL SHARES FOR THE CLIENT. CLAIM DENIED.
