Date: February 24, 2009
Category: Customer Dispute
Allegations: CLIENT'S SON, [FAMILY MEMBER], ALLEGES VARIABLE ANNUITY CONTRACT WAS AN UNSUITABLE INVESTMENT FOR HIS FATHER, [CUSTOMER].
Damage Amount Requested: $56,000.00
Broker Comment: THIS IS IN RESPONSE TO THE COMPLAINT THAT [FAMILY MEMBER] FILED AGAINST ME IN REGARDS TO THE JOHN HANCOCK ANNUITY THAT WAS SOLD TO HIS FATHER, [CUSTOMER]. I HAVE TAKEN INTO ACCOUNT [CUSTOMER'S] TOTAL PORTFOLIO FROM THE FIRST DAY THAT I STARTED WORKING WITH HIM IN THE REGISTERED REPRESENTATIVE ROLE. I WORKED WITH HIM ON GETTING HIS ESTATE IN ORDER BY WORKING WITH AN ATTORNEY TO DO THEIR ESTATE PLANNING. IN ADDITION, EVERY 3 MONTHS WE WOULD MEET AND GO THROUGH ALL OF HIS INVESTMENTS FROM REAL ESTATE TO THE CASH HE HAD ON HAND AND REVISIT HIS OBJECTIVES. [CUSTOMER] AND HIS WIFE HAD SEVERAL DIFFERENT ACCOUNTS WITH US AND THEY WERE ALL INVESTED TO MEET THEIR OBJECTIVES. THE INVESTMENT WAS DISCUSSED WITH [CUSTOMER] OVER SEVERAL DIFFERENT MEETINGS. HE WANTED TO PUT THE INITIAL $100,000 PREMIUM INTO THE NEW POLICY AND THEN DECIDED THAT THE OLD POLICY DIDN'T HAVE ALL OF THE GUARANTEES OF THE NEW POLICY. [CUSTOMER] REQUESTED TO TRANSFER THE FUNDS FROM THE OLD POLICY TO THE NEW POLICY. [CUSTOMER] WANTED TO MAKE SURE THAT THE MONEY IN THE ANNUITY WOULD BE AVAILABLE IF HE WENT IN THE NURSING HOME TO PAY THE DIFFERENCE THAT HIS LONG TERM CARE WOULDN'T COVER. HIS MAIN OBJECTIVE HOWEVER, WAS LONG TERM GROWTH POTENTIAL FOR FUTURE GENERATIONS, WHILE ASSURING HIS HEIRS RECEIVE AT LEAST HIS INITIAL INVESTMENT. AT NO TIME WAS HIS SON [FAMILY MEMBER] EVER INVOLVED IN THE PLANNING OF HIS INVESTMENT PORTFOLIO. WE ALWAYS MADE SURE THAT [CUSTOMER] AND HIS WIFE HAD ENOUGH CASH AVAILABLE IN THEIR INVESTMENTS, MONEY MARKET OR CDS TO COVER THEIR SHORT TERM EXPENSES.
