Allegations: CLIENT STATES THAT IN 1997 SHE PUT $100,000 INTO A TAX-DEFERRED ANNUITY WITH CONSECO. CLIENT STATES THE IR RECOMMENDED WHEN THE VALUE WAS AT $150,000 THAT SOME OF THE FUNDS BE WITHDRAWN DUE TO THE FINANCIAL SITUATION OF CONSECO AT THAT TIME. CLIENT STATES CONSECO SAID SHE COULD WITHDRAW UP TO $100,000 WITHOUT A PENALTY. CLIENT DID A PARTIAL WITHDRAWAL OF $85,000, WHICH THE CLIENT CLAIMS $50,000 ENDED UP BEING TAXABLE AND SUBJECT TO A 10% PENALTY. CLIENT STATES SHE DID NOT KNOW SHE COULD HAVE DONE AN EXCHANGE TO AVOID TAXES AND PENATIES. CLIENT STATES SHE DOES NOT FEEL SHE SHOULD HAVE TO INCUR THESE FEES AND WANTS TO KNOW HOW EDWARD JONES WILL RECTIFY THE SITUATION. ALLEGED LOSSES IN EXCESS OF $5,000.

Broker Comment: UPON FURTHER INVESTIGATION, THIS MATTER SHOULD NOT HAVE BEEN FILED AS A COMPLAINT. IR DISCOVERED THIS MISTAKE DURING A REVIEW MEETING WITH CLIENT AND CONTACTED HOME OFFICE FOR ADVICE AS TO HOW TO CORRECT THE MISTAKE. IR RECEIVED INCORRECT ADVICE STATING THAT MISTAKE COULD ONLY BE CORRECTED IF CLIENT SUBMITTED A LETTER OF COMPLAINT. IR RELAYED THIS INCORRECT INFORMATION TO THE CLIENT. THE FIRM WORKED WITH LINCOLN NATIONAL TO RESOLVE THE MATTER AND, ACCORDING TO THE IR, THE CLIENT NOW HAS A NEW AMERICAN LEGACY VARIABLE ANNUITY THROUGH LINCOLN NATIONAL. THERE WILL BE NO TAXES DUE AS LINCOLN NATIONAL HAS DATED THE CLIENT'S ANNUITY AS OF SEPTEMBER 3, 2003, WHEN THE FUNDS WERE ORIGINALLY WITHDRAWN FROM THE CONSECO ANNUITY. THIS WILL BE REPORTED AS A 1035 EXCHANGE BY THE CLIENT'S TAX PREPARER AND, ACCORDING TO THE IR, THE CLIENT IS SATISFIED WITH THIS RESOLUTION.
